1. Which Ministry is in charge of geological survey and what the legislation procedure looks like?

The Ministry of Economy of Montenegro is in charge of geological survey which must be carried out in accordance with the Law on Geological Survey („Off. Gazette RM“, no. 28/93, 27/94, 42/94, 26/07, and 28/11) download.
According to the valid legislation, geological survey is subject to prior development and revision of Survey Design. Investor is obliged to submit the revised Design for approval of geological works to the Ministry of Economy and to pay RAT in ammount of 150 €. According to the Amendment Law to the Law on Geological Survey („Off. Gazette RM, no. 28/11), download, certain types of structures do not require the approval for geological works, which primarily refers to residential objects and objects for gathering of number of people. These types of structures require development of Design of investigation which needs to be revised. The geological inspector is notified, via e-mail, on commencement of works and completion of works, and finally the Study on results of geological (geotechnical/hydrogeological) investigation is prepared. The Study is subject to revision, and eventually is submitted for approval of the Study to the Ministry of Economy. The approval is one of the conditions for issuance of Building Permit. Revision of Design and Study must be done by an independent Revision Committe consisting of three licenced geological engineers.
